TERMS AND CONDITIONS
AGREEMENT
By downloading, installing, accessing, or using this mobile application, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions, our Privacy Policy, Code of Conduct and Ethics Policy, and IPR Takedown Notice Policy. These Terms constitute a binding legal agreement between you and BaePool.
Your use of the app at any time signifies your acceptance of these terms.
If you disagree with any part of these terms, you must immediately cease using the app and uninstall it from your device. Continued use after any modifications to these terms constitutes acceptance of the revised terms.
We reserve the absolute right to modify, update, or change these Terms and Conditions at any time without prior notice. When material changes are made, we will notify users through in-app notifications, email communications, or prominent notices on the app interface.
Your continued use of the app following the posting of changes constitutes your binding acceptance of such changes. We recommend regularly reviewing these terms to stay informed of any updates. If you do not agree to any modifications, your sole remedy is to discontinue use of the app.
PLATFORM OVERVIEW
Our application is a comprehensive multi-vertical platform that integrates three distinct social networking services into one unified experience.
The social community vertical provides functionality, including photo sharing, video content creation, story features, social interactions, and community-building tools.
The professional networking vertical offers career development features, including professional profile creation, job networking, business connections, industry insights, and career advancement opportunities.
The dating and matrimonial vertical combines modern dating app features with traditional matrimonial services, including personal profiles, compatibility matching, family involvement options, and relationship-building tools designed to respect Indian cultural values and marriage traditions.
All three verticals are integrated within a single application interface, allowing users to seamlessly switch between different networking purposes while maintaining separate profile identities for each vertical.
Users can choose to use one, two, or all three services based on their personal needs and preferences. The platform maintains distinct privacy settings and visibility controls for each vertical to ensure appropriate separation of personal, professional, and matrimonial interactions.
Cross-vertical interactions are limited and controlled to maintain the integrity and purpose of each service area.
USER ELIGIBILITY
Users must be at least eighteen (18) years of age to create an account and use any features of this application across all verticals. This age requirement is uniform for social community features, professional networking services, and dating and matrimonial services.
No individuals under the age of eighteen are permitted to use this platform under any circumstances.
We reserve the right to request age verification documents, including government-issued identification such as an Aadhaar card, passport, or driving license, and failure to provide such verification when requested may result in immediate account suspension or termination.
Users must have the legal capacity to enter into binding agreements under applicable Indian laws. Users represent and warrant that they have the right, authority, and capacity to enter into this agreement and to abide by all terms and conditions herein.
Users who are married or in committed relationships must ensure that their use of dating and matrimonial services is appropriate and lawful according to their personal circumstances and applicable laws.
USER CONDUCT
Creating an account requires users to provide accurate, current, and complete personal information, including full legal name, valid email address, mobile phone number, date of birth, gender, and location details.
Users must create unique login credentials consisting of a username and a strong password, and are solely responsible for maintaining the confidentiality and security of their account information. The registration process includes accepting these Terms and Conditions, Privacy Policy, and Code of Conduct and Ethics Policy.
Users are permitted to maintain only one active account across all verticals, and creation of multiple accounts is strictly prohibited and may result in permanent account termination.
Our platform implements a multi-layered verification system to ensure user authenticity and platform safety. The verification process includes mandatory mobile number verification through SMS OTP, email address verification through confirmation links, live photo verification where users must take a real-time selfie that matches their profile photos, submission of one mandatory solo photograph for facial comparison and authenticity verification, and behaviour-based AI monitoring to detect and prevent impersonation, fraud, or suspicious activities.
All verification steps must be completed within the specified timeframe, and failure to complete any verification requirement may result in account restrictions or termination.
Users are responsible for all activities that occur under their account and must immediately notify us of any unauthorised access or security breaches.
Account sharing is strictly prohibited, and users must not allow others to access their account under any circumstances.
We employ advanced security measures, including encryption, secure authentication protocols, and continuous monitoring for suspicious activities.
Users must maintain current contact information and respond promptly to security-related communications from our platform.
ARTIFICIAL INTELLIGENCE FEATURES
Our platform utilises advanced artificial intelligence technologies to enhance user experience and safety across all verticals.
AI features include:
- sophisticated compatibility scoring algorithms that analyse user preferences;
- behavior patterns; and
- profile information to suggest potential matches in dating and matrimonial services;
- automated safety checks that continuously monitor content and communications to flag abuse, violence, harassment, or inappropriate behaviour; and
- intelligent bio generation tools that help users create engaging and authentic profile descriptions based on their interests and preferences.
These AI systems are continuously updated and improved to provide better accuracy and user protection.
By using our platform, users consent to the processing of their data through AI algorithms for the purposes of service improvement, safety enhancement, and personalised user experience. AI systems analyse user interactions, preferences, communication patterns, and profile information to generate insights and recommendations.
All AI processing complies with applicable data protection laws and our Privacy Policy. Users acknowledge that AI systems, while sophisticated, are not perfect and may occasionally produce inaccurate results or recommendations.
Users understand that AI-generated content, compatibility scores, and safety assessments are automated recommendations and should not be considered absolute or infallible.
AI systems are designed to assist and enhance user experience, but cannot replace human judgment and decision-making.
Users are encouraged to exercise their own discretion and critical thinking when interpreting AI-generated suggestions, compatibility scores, or safety alerts. We continuously work to improve AI accuracy but cannot guarantee perfect results in all situations.
SUBSCRIPTION PLANS AND PRICING
Service Tiers Our platform operates on a freemium model with multiple subscription tiers designed to meet diverse user needs.
- The Freemium plan provides basic access to all three verticals with limited features and standard matching capabilities.
- The Gold subscription, priced at INR 299 per week, offers enhanced features including priority matching, advanced filters, unlimited messaging, and increased profile visibility.
- The Elite subscription, priced at INR 599 per week, provides premium access with exclusive features, priority customer support, advanced compatibility analytics, and maximum profile exposure.
- The Superpower feature, available for INR 50 per day, offers temporary boosts in profile visibility and matching priority for users seeking immediate enhanced exposure.
Subscriptions are available in multiple billing cycles to accommodate user preferences and provide cost savings.
- Weekly subscriptions are charged every seven days, dual-payment options allow users to pay for two weeks at a discounted rate, monthly subscriptions provide four weeks of service with additional savings, quarterly subscriptions offer three months of service at significantly reduced per-week costs, and semi-annual subscriptions provide six months of premium access with maximum cost savings.
All subscriptions include automatic renewal functionality to ensure uninterrupted service, and users can manage their subscription preferences through account settings.
We regularly offer promotional discounts and special pricing for longer-term commitments and bundled services. Dual-payment options provide immediate savings compared to weekly billing, monthly packages offer substantial discounts over weekly payments, quarterly and semi-annual subscriptions provide progressive savings with longer commitments, and seasonal promotions may offer additional discounts during special periods. All promotional offers are subject to terms and conditions specific to each promotion and may have limited availability or duration.
PAYMENT PROCESSING
All subscription payments and in-app purchases are processed securely through Razorpay, our authorised payment gateway partner. Razorpay provides industry-standard security measures, including encryption, fraud detection, and secure transaction processing.
Users can pay using various methods, including credit cards, debit cards, net banking, UPI, digital wallets, and other payment options supported by Razorpay. All payment information is processed and stored securely by Razorpay in compliance with applicable financial regulations and security standards.
Subscriptions automatically renew at the end of each billing cycle unless cancelled by the user before the renewal date. Users will be charged the applicable subscription fee according to their selected billing cycle and payment method.
Renewal notifications are sent in advance to inform users of upcoming charges. Users can disable automatic renewal or change their subscription plan through account settings at any time.
Failed payment attempts may result in the temporary suspension of premium features until payment issues are resolved.
We do not store complete payment card information on our servers and rely entirely on Razorpay's secure payment infrastructure. All financial transactions comply with applicable Indian banking regulations, RBI guidelines, and international payment security standards.
Users are responsible for providing accurate payment information and maintaining current payment details for ongoing subscriptions.
Any suspicious payment activity or potential fraud is immediately investigated and may result in account suspension pending resolution.
REFUNDS AND CANCELLATIONS
Refunds are available within seven (7) days of the original purchase date only for genuine grievances including technical failures that prevent access to paid features, duplicate charges resulting from payment processing errors, or service interruptions that significantly impact the user experience.
Refund requests must be submitted through our customer support channels with a detailed explanation of the issue and supporting documentation where applicable.
Refunds are processed at our sole discretion after thorough investigation of the claim and may require additional verification or information from the user.
Users may cancel their subscriptions at any time through the account settings interface or by contacting customer support. Cancellation prevents future billing cycles but does not affect the current active subscription period. Users retain access to premium features until the end of their current billing cycle.
Cancellation requests must be submitted at least twenty-four (24) hours before the next renewal date to avoid the next billing cycle. Once cancelled, users can reactivate their subscription at any time by selecting a new plan and completing the payment process.
Refunds are not provided for change of mind, dissatisfaction with matching results, unsuccessful relationships or connections, completion of subscription periods, account termination due to policy violations, or any other circumstances not specifically covered in our refund policy.
- The digital nature of our services means that once accessed, premium features are generally non-refundable except in the specific circumstances outlined above.
- Users are encouraged to carefully consider their subscription choices and utilise free trial periods where available.
USER CONDUCT AND RESPONSIBILITIES
All users must strictly adhere to our comprehensive Code of Conduct and Ethics Policy, which forms an integral part of these Terms and Conditions. This policy outlines acceptable behaviour standards, communication guidelines, and ethical requirements for all platform interactions.
Users must treat others with respect, dignity, and cultural sensitivity while maintaining appropriate conduct across all verticals. Violations of the Code of Conduct may result in warnings, temporary restrictions, or permanent account termination depending on the severity and frequency of violations.
Users are responsible for all content they create, share, or communicate through our platform. All content must comply with applicable laws, cultural norms, and platform guidelines. Users cannot post, share, or communicate content that is illegal, harmful, offensive, discriminatory, or inappropriate for the intended audience.
Professional communications must maintain workplace-appropriate standards, social content should respect community values, and matrimonial interactions should honour traditional social values and cultural sensitivities.
Users have a responsibility to report inappropriate content, suspicious behaviour, or policy violations they encounter on the platform. Our reporting system allows users to flag content or users for review by our moderation team.
Users must not abuse the reporting system by filing false or malicious reports. Community safety is a shared responsibility, and users are encouraged to contribute to a positive and safe environment for all platform members.
INTELLECTUAL PROPERTY
Users retain ownership rights to all original content they create and share on the platform, including photographs, videos, written posts, and other creative materials.
However, by posting content on our platform, users grant us a comprehensive, non-exclusive, worldwide, royalty-free, transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content across all platform verticals and related promotional materials. This license extends to our subsidiaries, affiliates, and authorised partners for platform operation, improvement, and marketing purposes.
We respect intellectual property rights and have implemented a comprehensive IPR Takedown Notice Policy to address copyright infringement claims.
Users who believe their intellectual property rights have been violated can submit takedown notices through our designated channels.
We respond promptly to valid takedown requests and may remove infringing content and take appropriate action against violating users. Users who repeatedly infringe intellectual property rights may have their accounts permanently terminated.
Our application, including all software code, algorithms, user interface designs, graphics, logos, trademarks, service marks, and proprietary technologies, remains the exclusive intellectual property of Elisum AppDesi Solutions Pvt Ltd. Users are granted a limited, non-exclusive, non-transferable, revocable license to access and use the platform solely for personal, non-commercial purposes in accordance with these Terms.
Users cannot copy, modify, reverse engineer, decompile, or create derivative works from any aspect of our app.
PRIVACY AND DATA PROTECTION
Our comprehensive Privacy Policy governs the collection, use, storage, and protection of user personal information and forms an integral part of these Terms and Conditions. Users must read and agree to the Privacy Policy before using our platform.
The Privacy Policy details our data practices, user rights, security measures, and compliance with applicable privacy laws, including the Information Technology Act 2000 and upcoming data protection legislation.
By using our platform, users explicitly consent to the collection and processing of their personal information as described in our Privacy Policy. This includes profile information, communication content, usage patterns, location data, and other information necessary for platform functionality. Users understand that data processing is essential for providing matching services, safety features, and personalised user experiences across all verticals.
We implement industry-standard security measures to protect user data, including encryption, secure authentication, regular security audits, and compliance with applicable data protection regulations.
User data is stored securely within India in compliance with data localisation requirements, and cross-border data transfers are conducted only when necessary and with appropriate safeguards.
Users are responsible for maintaining the security of their account credentials and promptly reporting any suspected security breaches.
VERTICAL-SPECIFIC TERMS
The social vertical provides users with tools for personal expression, community building, and social networking similar to popular social media platforms. Users can share personal moments, thoughts, and experiences with their network through photos, videos, stories, and text posts.
- Content shared in this vertical may be visible to a broad audience based on privacy settings, and users should exercise appropriate discretion when sharing personal information.
- We facilitate social interactions through commenting, liking, sharing, and messaging features, but we are not responsible for the nature, quality, or consequences of user interactions.
Our professional vertical is designed to facilitate career advancement, business networking, and professional development opportunities.
- Users must provide accurate professional information including employment history, educational qualifications, skills, and career objectives. All professional interactions must maintain appropriate workplace decorum and business etiquette.
- While we provide a platform for professional connections, we do not guarantee employment opportunities, business deals, or career advancement.
- Users are responsible for verifying the credentials and legitimacy of professional contacts and opportunities.
Our dating and matrimonial vertical respects traditional Indian marriage customs while incorporating modern technology for partner discovery. Users must be genuinely seeking romantic relationships or matrimonial alliances and provide truthful personal information, including family background, lifestyle preferences, and relationship expectations.
- We understand and accommodate family involvement in the matrimonial process, which is an integral part of marriage traditions. Users acknowledge that matrimonial profiles may be viewed and evaluated by potential partners' families, and this family participation is considered normal and acceptable.
LIABILITY AND RESPONSIBILITY
Users acknowledge and explicitly agree that they bear complete and sole responsibility for all actions, decisions, communications, and consequences arising from their use of this platform. This comprehensive responsibility includes but is not limited to all interactions with other users, the accuracy and truthfulness of information provided, decisions made based on information received through the platform, and any offline meetings or relationships that develop through platform connections.
Users cannot hold the platform liable for the behaviour, actions, or misrepresentations of other users, and they accept full accountability for their own conduct and its consequences.
Users explicitly acknowledge and voluntarily assume all risks associated with online social networking, professional networking, and matrimonial services. These risks include but are not limited to encountering dishonest or dangerous individuals, privacy breaches, identity theft, financial fraud, emotional distress, physical harm from in-person meetings, professional disputes, failed relationships, unsuccessful matrimonial alliances, and social embarrassment.
Users understand that online interactions carry inherent uncertainties and potential dangers, and they choose to participate with full knowledge of these risks.
Users agree to indemnify, defend, and hold completely harmless Elisum AppDesi Solutions Pvt Ltd and BaePool, its directors, officers, employees, agents, affiliates, and partners from any and all claims, demands, losses, damages, costs, expenses, and liabilities including reasonable attorneys' fees arising from or related to their use of the platform, violation of these Terms, infringement of any rights of third parties, interactions with other users, content posted or shared, misrepresentation of information, or any illegal or unauthorized activities. This indemnification obligation survives termination of the user's account and continues indefinitely.
DISCLAIMERS AND LIMITATIONS
We strive to maintain continuous platform availability but do not guarantee uninterrupted, error-free, or completely secure service at all times. The App functionality may be temporarily disrupted due to maintenance activities, system updates, server issues, internet connectivity problems, or technical difficulties beyond our control.
We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice. Users acknowledge that technology platforms are inherently subject to occasional disruptions and limitations.
We explicitly disclaim all warranties and guarantees regarding platform performance, user experiences, and outcomes. We do not guarantee successful matches, romantic relationships, marriages, professional opportunities, job placements, business deals, or social connections through our platform.
We make no warranties regarding the accuracy, completeness, or reliability of information provided by other users, and we cannot verify all user claims or representations. The platform is provided on an "as is" and "as available" basis without any express or implied warranties.
To the maximum extent permitted by applicable law, Elisum AppDesi Solutions Pvt Ltd shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from platform usage. This limitation includes but is not limited to damages for lost profits, data loss, privacy breaches, emotional distress, physical harm, reputational damage, failed relationships, unsuccessful job searches, or any other losses, regardless of the theory of liability. Our liability for any claims related to platform usage shall not exceed the amount paid by the user for premium services in the twelve months preceding the claim.
ACCOUNT TERMINATION
Users may terminate their accounts at any time through the account settings interface or by contacting customer support. Account termination immediately revokes access to all platform features and services across all verticals. Users are responsible for downloading any personal content they wish to retain before termination, as we may delete account data according to our data retention policies.
Termination does not relieve users of obligations incurred prior to termination, including payment obligations, indemnification responsibilities, and liability for previous actions.
We reserve the right to suspend, restrict, or permanently terminate user accounts at our sole discretion for violations of these Terms, Code of Conduct breaches, inappropriate behaviour, illegal activities, security breaches, or any conduct that we determine is harmful to the platform or other users.
Account termination may be immediate and without prior warning for serious violations, or may be preceded by warnings for minor infractions. Terminated users forfeit all premium subscription benefits without refund and are prohibited from creating new accounts.
DISPUTE RESOLUTION
These Terms and Conditions are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. All disputes, claims, and legal proceedings arising from or relating to platform usage, these Terms, or user interactions must be resolved under Indian jurisdiction and legal frameworks.
Users consent to the application of Indian laws regardless of their location or nationality when using our platform.
Any legal disputes that cannot be resolved through alternative methods shall be subject to the exclusive jurisdiction of the competent courts located in Pune, Maharashtra, India. Users irrevocably consent to the jurisdiction of these courts and waive any objections to venue or inconvenient forum. All legal proceedings must be conducted in the English language, and users agree to bear their own legal costs unless otherwise determined by the court.
Before initiating court proceedings, parties are encouraged to resolve disputes through binding arbitration conducted in accordance with the Arbitration and Conciliation Act. Arbitration proceedings shall be conducted in English by a single arbitrator mutually agreed upon by the parties or appointed according to the arbitration rules. The seat of arbitration shall be Pune, Maharashtra, India, and the arbitrator's decision shall be final and binding upon all parties.
COMPLIANCE AND REGULATIONS
Users must comply with all applicable Indian laws, regulations, and legal requirements while using our platform. This includes but is not limited to the Information Technology Act 2000 and its amendments, Criminal Laws, Consumer Protection Act 2019, and any future data protection legislation.
Users are also bound by applicable state and local laws, religious personal laws for matrimonial matters, and any specific regulations governing online platforms and digital communications in their jurisdiction.
Given India's diverse cultural, religious, and social landscape, users must exercise appropriate cultural sensitivity and respect in all platform interactions.
Content and communications should not offend or discriminate against any community, religion, caste, language group, or regional identity.
Users should be mindful of local customs and traditions, particularly in matrimonial interactions where family values and cultural practices vary significantly across different regions and communities.
FORCE MAJEURE
We shall not be held responsible or liable for any failure or delay in the performance of any obligation under these Terms where such failure or delay results from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, epidemics, pandemics, governmental or regulatory actions (including restrictions on app distribution through Google Play Store or Apple App Store), technical failures, cyber-attacks, power outages, internet or telecommunications disruptions, third-party service provider failures (including cloud hosting providers and payment gateways), or any other events of a similar nature.
During the occurrence of any such event, our obligations under these Terms shall be suspended for the period of the Force Majeure event. We shall make reasonable efforts to resume the App's operations as soon as practicable.
